Welcome to PromptPixels. These Terms of Service ("Terms") govern your access to and use of our comprehensive suite of AI-powered creative tools and services (collectively, the "Service"). By registering for an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Description of Service

PromptPixels is a comprehensive AI-powered creative platform that provides multiple specialized tools and services:

1.1 AI Generation Tools (Credit-Based)

• AI Image Studio: Generate high-quality images from text prompts using advanced AI models with customizable parameters including aspect ratios, safety filters, and style preferences. This includes specialized generation capabilities such as car designs, nail art patterns, and other themed content.
• AI Avatar Studio: Create custom avatars and characters, including the ability to train personal character models from uploaded images for consistent character generation.
• AI Image Editor: Transform and edit existing images using AI-powered style transfer, enhancement, and modification capabilities with natural language prompts.
• Image Upscaler & Enhancer: Enhance and upscale low-resolution images using AI technology to improve quality, sharpness, and detail.

1.2 Free Browser-Based Tools

• Add Text to Image: Add custom text overlays to images with various fonts, colors, and styling options. This tool operates entirely within your browser and requires no credits or account registration.

1.3 Platform Features

• Dashboard Management: Access your generation history, manage credits, and monitor account activity.
• Credit System: Purchase and manage credits for AI-powered tools with transparent pricing and usage tracking.
• User Account: Secure Google OAuth authentication with personal settings and preferences.

2. Account Registration and Security

• Authentication: You can register using either a valid Google account through our secure OAuth system or by creating a manual account with email and password. You are responsible for maintaining the confidentiality of your account credentials.
• Account Responsibility: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
• Age Requirement: You must be at least 13 years old to create an account and use our services.
• Account Accuracy: You agree to provide accurate and complete information when creating your account and to keep this information updated.

3. Credits and Payment System

3.1 Credit Consumption

• 1 Credit Tools: AI Image Studio and Image Upscaler each consume 1 credit per use.
• 2 Credit Tools: AI Avatar Studio and AI Image Editor each consume 2 credits per use due to their advanced processing requirements.
• Character Training: Custom character training for AI Avatar Studio requires exactly 20 credits per training session.
• Free Tools: The Add Text to Image tool is completely free and does not require credits or account registration.

3.2 Credit Purchase and Management

• Payment Processing: Credits can be purchased via our third-party payment processor, Polar SH, using secure payment methods.
• Credit Packages: We offer various credit packages with transparent pricing. Current pricing is displayed on our purchase page.
• Credit Validity: Credits do not expire, but we reserve the right to modify credit pricing or structures with reasonable notice.
• Non-Refundable: All credit purchases are final and non-refundable, except as required by applicable law.

3.3 Refund Policy

• Used Credits: Unfortunately, credits cannot be refunded after successful use because each AI generation process incurs real costs including server expenses, third-party API fees, payment processing fees, and computational resources.
• Technical Issues: We have automated systems that detect technical failures and automatically refund credits when generation processes fail due to system errors. If you experience a technical issue and do not receive an automatic credit refund, please contact us at [email protected] with details of the issue.
• Legal Requirements: Refunds may be provided where required by applicable consumer protection laws.

4. Acceptable Use of the Service

4.1 Content Guidelines

• Lawful Use: You agree to provide accurate prompt information and not to submit any content that is unlawful, harmful, defamatory, or infringes on any third-party rights.
• Safety Compliance: All generated content must comply with our safety policies and community guidelines.
• Appropriate Content: You may not generate content that is sexually explicit, promotes violence, contains hate speech, or violates intellectual property rights.

4.2 Usage Limitations

• Rate Limiting: We implement rate limiting to ensure fair access for all users and prevent system abuse.
• Content Filtering: We reserve the right to block or filter content deemed unsafe or in violation of our policies using both automated and manual review processes.
• Account Suspension: Excessive abuse or violation of these terms may result in account suspension or termination.

5. Prohibited Conduct

You shall not:

• Illegal Activities: Use the Service for any illegal or unauthorized purpose under applicable law.
• System Interference: Reverse engineer, decompile, or attempt to extract the source code of the Service or interfere with its integrity or performance.
• Unauthorized Access: Attempt to gain unauthorized access to other user accounts, computer systems, or networks connected to the Service.
• Automated Abuse: Use automated systems or bots to abuse the Service or generate excessive requests.
• Content Violation: Generate content that violates copyright, trademark, or other intellectual property rights of third parties.
• Harmful Content: Create content intended to harass, threaten, or harm others or that promotes illegal activities.

6. Intellectual Property and Licensing

6.1 Platform Ownership

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, and software, are owned by PromptPixels or our licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 Generated Content Rights

• AI-Generated Images: You retain full commercial and personal usage rights to all images generated through our AI tools (Image Studio, Car Generator, Nail Art Generator, Avatar Studio, Image Editor, and Upscaler).
• Edited Content: For AI-edited images, you must own the rights to the original image. You retain full rights to the final edited result.
• Character Models: You retain rights to characters trained from your uploaded images, subject to compliance with our terms.
• Text-Enhanced Images: For the Add Text to Image tool, you must own rights to the original image and retain full rights to the final image with text overlays.

6.3 License to Use Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or commercial purposes.

7. Privacy and Data Protection

• Privacy Policy: Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
• Data Processing: By using the Service, you consent to the collection, processing, and storage of your data as described in our Privacy Policy.
• Image Data: Uploaded images for enhancement or editing are processed securely and deleted after processing completion.
• Browser-Based Tools: Our Add Text to Image tool processes data entirely within your browser and does not transmit data to our servers.

8. Service Availability and Modifications

• Service Availability: We strive to maintain high service availability but do not guarantee uninterrupted access to the Service.
• Maintenance: We may temporarily suspend the Service for maintenance, updates, or improvements with reasonable notice when possible.
• Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice to users.
• Feature Updates: We may add new features, tools, or modify existing functionality to improve user experience.

9. Account Termination

• Termination by Us: We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or for any other reason at our sole discretion.

10. Disclaimers and Warranty

• As-Is Service: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
• AI Limitations: We do not guarantee the accuracy, quality, or appropriateness of AI-generated content for any specific purpose.
• Technical Issues: We are not responsible for technical difficulties, internet connectivity issues, or device compatibility problems.
• Third-Party Services: We disclaim responsibility for the performance or availability of third-party services integrated with our platform.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Damages Limitation: PromptPixels and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
• Maximum Liability: Our total liability to you for all claims related to the Service shall not exceed the amount paid by you for credits in the 12 months preceding the claim.
• Business Interruption: We are not liable for any loss of profits, revenue, data, or business opportunities.

12. Indemnification

You agree to indemnify, defend, and hold harmless PromptPixels and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Dispute Resolution

• Arbitration: Any disputes that cannot be resolved informally may be subject to binding arbitration as specified by applicable law.
